The practices after Leyla Sahin decision of the EHRC in Turkey The practices after Leyla Sahin decision of the EHRC in Turkey, the picture of the student wearing headscarf was removed from former yearbook. EHRC made public its decision on Leyla Sahin’s case on December 10 2005. In this decision has concluded that banning students who wear headscarf from schools does not constitute a violation of the Convention. As known, since 1988 the ban enforced on headscarf with gaining momentum in Turkey and the students wearing headscarf were not allowed to go universities. In this ongoing enforcement of the ban, even student’s mothers who wear headscarf were not allowed to enter university premises for their children’s graduation ceremony. Due to EHRC’s decision on the ban headscarf that was found no violation of the law were resulted in deprivation of hundred thousands young students from education only because of their religious believes. Following this decision, some universities have started to remove the pictures of former students wearing headscarf from the yearbooks in which those students graduated wearing headscarf from the universities before the ban. It is a common concern of us that EHRC’s this decision contradicts to its own foundational principles and human rights norms. The Court’s approach to the ban also constitutes and seen as double standard. It is also shared worry that following cases will be treated and concluded the same way. Therefore it is anticipated to see women wearing headscarf will be subjected every sort of discriminatory treatment.
