The practices after Leyla Sahin decision of the EHRC in Turkey

The practices after Leyla Sahin decision of the EHRC in Turkey, the picture of the student wearing headscarf was removed from former yearbook. EHRC made public its decision on Leyla Sahin’s case on December 10 2005. In this decision has concluded that banning students who wear headscarf from schools does not constitute a violation of the Convention. As known, since 1988 the ban enforced on headscarf with gaining momentum in Turkey and the students wearing headscarf were not allowed to go universities. In this ongoing enforcement of the ban, even student’s mothers who wear headscarf were not allowed to enter university premises for their children’s graduation ceremony. Due to EHRC’s decision on the ban headscarf that was found no violation of the law were resulted in deprivation of hundred thousands young students from education only because of their religious believes. Following this decision, some universities have started to remove the pictures of former students wearing headscarf from the yearbooks in which those students graduated wearing headscarf from the universities before the ban. It is a common concern of us that EHRC’s this decision contradicts to its own foundational principles and human rights norms. The Court’s approach to the ban also constitutes and seen as double standard. It is also shared worry that following cases will be treated and concluded the same way. Therefore it is anticipated to see women wearing headscarf will be subjected every sort of discriminatory treatment. In the appendix, we present to your attention a newspaper clips reporting such violation.

THE PICTURES OF FORMER STUDENTS WEARING HEADSCARF REMOVED FROM YEARBOOK
Faculty of Communication, Istanbul University enforced the ban on headscarf on former students. The Faculty celebrated its 55th year of establishment and prepared a student album that includes the entire student body from the beginning of its establishment. However, the pictures of students wearing headscarf were not placed in the album. While Seyma Aksiz Akyurek graduated 1996 and took her place in the yearbook of the class 1996, in the new album her picture was removed. Akyurek emphasized while she was student in the university, she did not have any problem whatsoever with her professors and friends; She believes that some people are worried of documentation that student in the past were accepted with their headscarf. Prof Dr. Fuat Sezgin, Dean of the Faculty of Communication, has confirmed that the ban was carried out in the album against students wearing headscarf. When he was reminded of past practices that the pictures of students wearing headscarf had took their place in the yearbooks, Gezgin said that “the previous yearbooks were prepared by the students, this year if even they are prepared by students, there would not be any picture that is with headscarf.”
